New waiver

1. ASSUMPTION OF RISK

I understand and voluntarily accept all risks, known and unknown, inherent or otherwise, associated with using the facilities, services, and premises of Fire & Ice Wellness Ltd (the "Company") and Westbury Wildlife Park generally, including but not limited to:

- Wood-Fired Sauna: Burns, smoke inhalation, dehydration, hyperthermia, dizziness, cardiovascular issues, fainting, respiratory issues, fire hazards, equipment malfunction, or collisions.

- Organic Swimming Pool: Drowning, slipping, bacterial/parasitic infections, allergic reactions, wildlife encounters (e.g., insects, amphibians), or algae-related injuries.

- Wildlife Park: Uneven terrain, falling branches, animal bites/stings, exposure to extreme weather (heat, cold, storms), tripping hazards, or encounters with wild animals.

- General Facility Risks: Act of nature and acts of other users of the facilities

The participant acknowledges that their participation in the ice bath and sauna services is entirely voluntary and that they are free to withdraw at any time.

I acknowledge that participation may result in serious injury, illness, permanent disability, emotional distress, property damage, or death, and I voluntarily assume full responsibility for all such risks.

2. RELEASE OF LIABILITY

In exchange for being permitted to use the facilities, I hereby waive, release, discharge, and covenant not to sue Fire & Ice Wellness Ltd, its owners, employees, contractors, agents, affiliates, and property owners (collectively, "Released Parties") from any and all claims, demands, actions, liabilities, or damages (including legal fees) arising from or related to:

- Personal injury, illness, disability, or death caused by my use of the facilities (but not gross negligence or wilful misconduct) of the Released Parties.

- Property damage, theft, or loss of personal belongings, vehicles, or equipment.

- Acts or omissions of third parties, wildlife, or environmental factors (e.g., weather, natural disasters).

This release applies to all past, present, and future claims.

3. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties against any claims, lawsuits, damages, or costs (including legal fees) arising from:

- My breach of these Terms, misuse of facilities, or violation of safety rules.

- My negligence, recklessness, or intentional misconduct.

- Claims brought by third parties (e.g., family members, insurers) related to my participation.

4. ACKNOWLEDGMENTS

I confirm that:

- I am physically and mentally fit to participate in sauna use, swimming, and outdoor activities.

- I have no medical conditions including but not limited to: heart disease including high or low blood pressure, pregnancy, respiratory issues, seizures, diabetes, suffering from infectious skin disease, that could be aggravated by the facilities and I have consulted a GP prior to entering the facilities.

- For the avoidance of doubt, if you suffer from any condition whatsoever that makes the user unsure as to the advisability of using the sauna, organic pool, showers or the facilities generally, you should consult your GP for advise on suitability prior to use of any of the facilities.

- I am not under the influence of alcohol, drugs, or medications impairing judgment or physical ability.

- I have read and agree to all terms and conditions, posted rules, warnings, and instructions.

- The Company does not guarantee safety and makes no warranties about facility conditions.

- In the event that I am making a booking on behalf of myself and others i.e. a group booking or otherwise, I have made all others prospective participants aware of this liability waiver and have permission by all to indicate that they accept the terms set out herein.

6. GOVERNING LAW & SEVERABILITY

- This Waiver is governed by the laws of England and Wales.

- If any provision is deemed unenforceable, the remainder shall remain valid.

ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE READ THIS WAIVER, UNDERSTAND ITS TERMS, AND SIGN IT VOLUNTARILY. I WAIVE SUBSTANTIAL LEGAL RIGHTS.
